If your Design is selected for use by S2SNation.com, you acknowledge that you assign to S2S Nation Inc. the entire right, title, and interest in and to the copyright in your Design including the right to sue for past infringement and the right to further sub-license the Design, for its sole and exclusive use on and in connection with the clothing and prints. You also acknowledge that you waive all "moral" rights that you may have in and to your Design.
If your Design is selected, S2S Nation Inc. may use your Design in any manner on or in connection with the clothing and prints, including but not limited to: reproducing the Design on the clothing and prints, selling clothing and prints bearing the Design, changing or reworking the Design by making color or size changes, making derivative works of the Design, using the Design on the S2SNation.com website and on promotional material for S2SNation.com, and registering the Design with the Canadian and US Copyright Office in the name of S2S Nation Inc. as the Claimant, and you as the Author. You agree to provide S2SNation.com with minimal information as may be required in order to register the copyright of the Design if S2Snation.com so requests, at no cost.
When the voting takes place, the ip address of the person that votes is recorded to prevent contestants or people from voting over and over again for the same design. S2S Nation Inc. reserves the right to disqualify any design that attempts to manipulate the voting by excessively voting for a design repeatedly. The system will also lock you out from voting if you try to vote a large number of times for the same design. Also please refrain from intentionally voting down other designs repeatedly. It is no problem to vote for other designs whatever rating you choose, however, if we find that you are intentionally voting down other designs repeatedly, your design will be eliminated and you may be barred from submitting design in the future. The final selections will be made by S2S Nation Inc. when all factors listed in the "Submit Design" section of our website are considered. All decisions made by S2S Nation Inc. with regards to the shirt selections are final and binding.
You may use or continue to use the Design for any other purposes, except those described below.
If your Design is selected, you may not use the Design (or derivatives of the Design) or allow others to use the Design (or derivatives of the Design) on any clothing items or prints, as described above. In addition, by submitting your Design, you may not reproduce, sell, or submit the Design to others for any commercial purpose for sixty (60) days after the date of submission while the Design is being evaluated by S2SNation.com. Once the sixty (60) days have passed, if your Design is not chosen for print by S2SNation.com, you are free to use the Design for any commercial or non-commercial purpose. However if your Design is used elsewhere, you must notify S2SNation.com by email This e-mail address is being protected from spambots. You need JavaScript enabled to view it about where and when the Design will be used, so that it can be removed from the S2SNation.com website at that time. In addition, if the Design is used or reproduced for commercial purposes elsewhere, you cannot use the S2SNation.com website to promote the Design or the company using the Design. You further agree not to use the S2Snation.com website to promote the products and services of any company that operates in competition with S2SNation Inc. S2S Nation Inc. reserves the right to choose your design after the (60) days have passed, on the condition that the design has not been used for commercial purposes on any Items, as described above.
You acknowledge that the Design you are submitting to S2S Nation Inc. is your own original work, has not been previously published, and does not contain any trademarks, logos, copyrighted material, or any other intellectual property belonging to any third party, or any material, which S2S Nation Inc. in its sole discretion, deems to be profane or offensive.
You acknowledge that S2S Nation Inc. reserves the right to decline to select a Design for consideration for any reason, including poor design, as further explained in the "Reasons Your Design Might Get Rejected" page of the S2S Nation.com design submission package, which is subject to change at any time.
If your Design is selected for use by S2S Nation Inc. you will receive: $250 cash when your design is selected printed and is available for sale and $250 at the end of the next month. You will also receive a 5% commission for every clothing item or print that is sold on S2SNation.com. You will receive a $200 Gift Certificate, good for use on any purchase from the S2SNation.com website. Further, if your design is selected for use by S2SNation.com, you will automatically be entered into the quarterly Best of the Best competition and will receive a 5% commission on every shirt sold if your design is voted as the Best of the Best
You alone will be responsible for the payment of any tax that arises as a result of receiving payment from S2SNation.com. Payment will be sent through PayPal to your PayPal account according to the timeline described above. You will receive your commission payments monthly or in full when the Design sells out. S2S Nation Inc. must receive a hi-resolution artwork deemed suitable for print before any payment is made. If the hi-resolution artwork is not deemed suitable for print as determined by S2SNation.com, S2SNation.com will notify you of the reason(s) for its determination by email and will make a good-faith effort to assist you in presenting a suitable hi-resolution format.
Participants, who in the opinion of S2S Nation Inc. do not comply with these Design Submission Legal Terms and Conditions, or for any other reason at S2S Nation Inc. sole discretion, can at any time be excluded from consideration without notice.
The decisions of S2S Nation Inc. are final and binding.
